Fines for bid rigging cartel of window producers were confirmed

The Chairman of the Office for the Protection of Competition, Mr. Petr Rafaj, rejected the appeal of the undertakings DAFE-PLAST Jihlava, s.r.o., OFS 2000, s.r.o. and SULKO s.r.o., and confirmed the first-instance decision issued last year imposing the fines of CZK 20 841 000 on these undertakings for a bid rigging cartel agreement. The decision is already final.

The above mentioned undertakings infringed national competition rules by coordinating their participation and bids regarding the public contract for the change of doors and windows on premises of the Ministry of Education, Youth and Sports announced by the Liberec Region in 2012, when they agreed that SULKO will submit the best tender. For the anticompetitive conduct of these undertakings, the Office imposed a fine of CZK 4 878 000 on DAFE-PLAST, a fine of CZK 337 000 on OSF and a fine of CZK 15 626 000 on SULKO.

The Chairman of the Office rejected all objections claiming in particular insufficient examination of the facts as well as proofs of anticompetitive conduct, and questioning the amount of imposed fines.
