ČEZ offered sufficiant commitments, no fine imposed

The Office for the Protection of Competition discontinued its administrative proceedig instituted against the company ČEZ a.s. for abuse of its dominant position in the purchase of coal from Sokolovská uhelná mine after the competitor had offered proper commitments.

The Office found that the existing contract between these companies contained arrangements discriminating Sokolovská uhelná. To remedy competition concerns ČEZ offered number of commitments, such as price adjustments in favour of Sokolovská uhelná and arrangement of long-term coal supply contract until mine-out. The Office decided to impose no fine, because the competitor pleaded guilty and substantially contributed to quick remedy. Moreover, the anticompetitive conduct occured only for a short time and didn´t create significant adverse effect on the market.
