The Office will file a cassation complaint

The Office for the Protection of Competition is going to file later this week a cassation complaint to the Supreme Administrative Court against the ruling of Regional Court in Brno in the RWE Transgas case. The Office decided in the past that the company RWE Transgas abused its dominant position in the natural gas market infringing both Czech and European competition law. The company was fined 240 million CZK.

However, Regional Court in Brno overruled the decision of the Office stating that it is not possible to apply both Czech and European law within a single proceeding. The Office is not aligned with this legal opinion and therefore will turn to the Supreme Administrative Court. In a view of the Office, parallel application of Czech and European competition law is conventional in majority of EC Member States and is also explicitly anticipated in the Council Regulation (EC) No 1/2003.
