What´s new in competition?

Michal Petr

Vice-chair, Office for the Protection of Competition (UOHS)

Michal Petr, was appointed as Vice-Chairman of the Office for the Protection of Competition on 1st November 2010, he graduated from the Faculty of Law at Palacky University, Olomouc as well as at Masaryk University, Brno. For several years he worked as Director at Section of Legislation and International Affairs and as a chairman of the appellate commission of the Office. In the academic sphere, he worked as a lecturer at Faculty of Economics and Administration of Masaryk University and the Faculty of Law, Palacky University, both in the field of competition law and European law. At the Office he particularly worked on the amendment of the Act on Protection of Competition within the accession of the Czech Republic to the EU. He is co-author of the book Prohibited agreements and abuse of dominant position in the Czech Republic, he has published annotations on the Competition legislation as well as legislation concerning the Public Procurement, he has published several articles on competition as well as articles on Community law.

Milan Brouček

Milan Brouček studied economics and management at public University at the PV Vyskov, Faculty of National Defense Economics. In 2000-2004 he worked as a teacher and analyst. In 2004 he began to work at the Office for the Protection of Competition as director of the Economic department. Since the beginning of 2009 he has been working as the Chief Economist.

Igor Pospíšil

Igor Pospíšil was born in 1977. In 2001, he graduated from the Faculty of Law at the Masaryk University in Brno. He has worked as a lawyer at the Office for the Protection of Competition since 2001. From 2005 to 2008, he was the Head of Working Group Professional Services, between 2006 and 2007, he was the Director of Department II., Competition Section I., which was later called Section of Production and Retail. He has been the Director of Cartel Department since 2007. From 2004 to 2007, he was also active as a tutor accredited by the Ministry of Interior for the area of administrative law. He has contributed to the elaboration of a number of documents published by the Office for the Protection of Competition, and took part in many conferences and workshops in the area of competition. He lectures occasionally at the Academy of Justice. He speaks Czech, English and German.

Martin Vitula

Head of Mergers Department

Martin Vitula was born in 1978. In 2001, he graduated from the Faculty of Economics and Administration of the Masaryk University. He has worked as an economist at the Office for the Protection of Competition since 2001. In 2004, he was placed in charge of Merger Department; from January to August 2007 he worked as the Director of Department I. of the Competition Section, where he focused on competition in the energy sector and industry. Since September 2007, he has worked as the Director of Merger Department. He has contributed to the elaboration of a number of documents published by the Office for the Protection of Competition, and took part in many conferences and workshops in the area of competition. He speaks Czech and English.

Rainer Lindberg

Completed M.Sc degree in Economics from the University of Helsinki, Finland. Before empoyed by FCA, worked as a private consultant (related especially banking competition). Several positions at the FCA (case handler/researcher 1995-2000, head of cartels unit 2003-2007, head of international affairs 2000-2003 and since 2007). Member of the FCA Board since 2000. Has represented the Finnish Government and Finnish Competition Authority in EU, OECD, ICN and other international working groups (eg. relating to EU vertical restraints block exemption, and Council Reg 1/2003 ). Expert panelist and lecturer in OECD’s Competition Capacity Building Programmes.

Pavel Dejl

JUDr. Pavel Dejl, Ph.D., LL.M. graduated from the Law Faculty of Charles University in Prague, the University of Amsterdam (LL.M - 1996), and he finished Postgraduate Doctoral Studies at the Law Faculty of Charles University in Prague in the field of private law (Ph.D. - 2002). He has been working as an attorney at law since 1998; his specialization is competition law, litigation and arbitration, Community law, insolvency law including the reorganization. Dr. Dejl speaks fluent English and Spanish. He is a member of the Czech Bar Association and the co-author of The International Comparative Legal Guide to: Litigation & Dispute Resolution, 2008, Global Legal Group; Chapter CR, A Practical Guide to the National Competition Rules Across Europe - second Edition, Kluwer Law International, 2008; chapter CR, and Leniency Regimes - second Edition, The European Lawyer Ltd., 2008; chapter CR.

JUDr. Jiří Jaroš, Ph.D. studied at the Law Faculty of Charles University between 1995 and 2000. He worked as an articled clerk with the law firm Rott, Ruzicka & Guttmann until 2003. Since 2005 he has worked as a partner with the law firm Nipl, Žák, Slavíček, Jaroš a spol. He specializes in commercial and competition law, M & A, labor law.

Stanislav Kadečka

JUDr. Stanislav Kadečka, Ph.D. studied for a Master’s degree in law (1999); Rigorous studies in the field of administrative law (2000) and Doctoral studies in the field of administrative law (2003) at the Law Faculty of Masaryk University in Brno. In 2004, he was awarded the Prize of the Rector of Masaryk University in Brno for excellence in doctoral studies. He currently works as a lecturer (assistant professor and the head of the Department of Administrative Studies and Administrative Law) at the Law Faculty of Masaryk University and he practices law as an attorney-at-law with a focus on administrative law. He is the Vice Chairman of the Working Committee (Public Law I - the Committee on Administrative Law No. 1) of the Legislative Council of the Czech Republic, a member of the Appellate Committee of the Czech National Bank and the Appellate Committee of the Ministry of Justice, etc. In his professional activities, he has long focused on the issue of self-government (both local and professional) and the law of self-government, as well as the issue of administrative processes and judicial control of the Public Administration. He is the author of one monograph (Právo obcí a krajů v České republice. C.H. Beck, 2003) and one commentary (Zákon o místních poplatcích a předpisy související. C.H. Beck, 2005); the leader of the team of authors of the explanatory publication Správní řád (ASPI, 2006), and the co-author of several administrative law textbooks and several practical guides for Public Authorities.

Jiří Kmec

Office of the Government Representative of the Czech Republic before the European Court of Human Rights

Jiří Kmec graduated from Lycée Carnot in Dijon, France (1996), and studied political science at the Institute of Political Studies of the Faculty of Social Sciences (Bachelor's degree 2000, Master’s degree 2003) and law at the Law Faculty of Charles University in Prague (Mgr. 2001, JUDr. 2003, Ph.D. 2006). Since 2002 has been working with the Ministry of Justice – the Office of the Government Representative of the Czech Republic before the European Court of Human Rights. He publishes regularly in Czech legal journals; in recent years, especially on the current judicature of the European Court of Human Rights (Právní zpravodaj, Soudní rozhledy). In 2006, C.H. Beck Publishers issued his monograph of the European Criminal Law.

He lectures occasionally, especially at the Law Faculties of Charles University in Prague and the West Bohemian University in Plzeň, and at the Judicial Academy.

Jiří Kindl works with the law firm WEIL, GOTSHAL & MANGES s.r.o.; he has long specialized in the protection of competition. He graduated summa cum laude at the Law Faculty of Charles University in Prague. He also studied law at the University of Limerick in Ireland and the Magister Juris postgraduate course at the Faculty of Law, University of Oxford (University College), where he received the Medal (Distinction) and the Clifford Chance Prize (Best Student of the Year in the Magister Juris program), Winter Williams Prize (Best Student in the subject of the European Business Regulation), and Monckton Chambers Prize (Best Student in the subject of Competition Law). In the publication of Chambers Europe 2007, has was rated as a lawyer “who becomes one of the best competition lawyers" in the Czech Republic.

Jiří Nováček graduated from the University of Economics in Prague, Faculty of International Relations, Prague Charles University, School of Law (awarded Mgr.) and Utrecht University, School of Law in Netherlands - International Masters Program in Law and Economics (awarded LL.M.). Antonín Panák

Antonín Panák pracoval v letech 2001 – 2002 na Ministerstvu obrany v Praze na odboru akviziční politiky. Od r. 2002 až po současnost působí na Energetickém regulačním úřadu v Jihlavě, od r. 2006 do r. 2009 jako vedoucí legislativního oddělení. Od 1. ledna 2010 pracuje jako ředitel legislativně právního odboru. Vystudoval Masarykovu univerzitu v Brně  Právnická fakulta, studium LL. M., obchodní právo.

Petr Zákoucký

JUDr. Petr Zákoucký, LL.M. je advokátem v Clifford Chance v Praze a specializuje se na oblast hospodářské soutěže a energetiku. V roce 2009 absolvoval půlroční praxi v soutěžní skupině Clifford Chance v Bruselu, v roce 2006 u Generálního ředitelství pro hospodářskou soutěž (DG Competition) Evropské komise v Bruselu a u Soudu prvního stupně EU v Lucemburku. Vystudoval Právnickou fakultu Univerzity Karlovy v Praze (2002), v rámci které absolvoval roční výměnný pobyt na právnické fakultě  Manchester Metropolitan University. Získal postgraduální titul LLM v oblasti evropského obchodního práva v Amsterdamu (2005) a německého práva v Tübingenu (2004). Advokátem se stal v roce 2008.

Katie is currently Head of Econometrics and Economic Policy at the Office of Fair Trading, where she looks at a wide range of issues including mergers, abuse of dominance cases and broader market studies.

Daniel Donath

CRA Charles River Associates

Currently, Daniel Donath is a member of the Chief Economist Team at the Directorate-General for Competition; he focuses mainly on the use of econometrics and other quantitative techniques in merger and antitrust cases. Before coming to Brussels, he worked at CRA International in London and also as the manager for economics consultancy at Deloitte's Washington office.

In his previous private practice, he dealt with a number of EU merger cases and contributed to the elaboration of damage calculation and regulatory analyses in telecommunications and financial services. He holds Ph.D. in Economics from the Pennsylvania State University.

Derek Ridyard

Derek Ridyard (derek.ridyard@rbbecon.com) is a Partner and co-founder of the economic consulting firm, RBB Economics.  He has worked as a consultant on the economics of competition law since 1987, prior to which he was an economist in the Office of Fair Trading in London.  

Derek has worked on assignments for clients involved in competition law cases across a wide range of industries and most of the European jurisdictions.  He has worked on some of the leading cases under the EUMR and Articles 101 and 102 (and their national equivalents) for clients including Nokia, Ticketmaster, Coca-Cola, SAS, IMS Health and Ryanair.  He has appeared as an expert witness on competition litigation proceedings in courts in London, Dublin and Oslo.  He is the author of numerous articles on the economics of competition policy and intellectual property, and is a member of the editorial board of the European Competition Law Review.

Hans Zenger

Hans Zenger is a Member of the Chief Economist Team at the European Commission's Directorate-General for Competition, where he works as an antitrust economist since 2007. He contributed to a number of high profile antitrust cases, mergers, and the development of Guidelines. Hans holds a Ph.D. in Economics from the University of Munich and an M.Sc. in Economics from Universitat Pompeu Fabra in Barcelona. He has published on the topic of competition policy in a number of refereed journals, including the Antitrust Law Journal and the Journal of Competition Law & Economics.
